A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the authority of the board of regents of the University
1-3 of North Texas to levy student fees for medical services.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 54.5081, Education Code, is amended to
1-6 read as follows:
1-7 Sec. 54.5081. MEDICAL SERVICES FEE; UNIVERSITY OF NORTH
1-8 TEXAS. (a) The [governing] board of regents of the University of
1-9 North Texas may charge each student registered at the university a
1-10 medical services fee not to exceed $75 [$25] for each semester of
1-11 the regular term or 12-week summer session and not to exceed $37.50
1-12 [$12.50] for each six-week or shorter term of the summer session.
1-13 (b) Before charging a medical services fee, the board must
1-14 give students and administrators an opportunity to offer
1-15 recommendations to the board as to the type and scope of medical
1-16 services that should be provided.
1-17 (c) The board may not increase the amount of the medical
1-18 services fee by more than 10 percent from one academic year to the
1-19 next unless the amount of the increase is approved by a majority of
1-20 the students at the university voting in a general election held at
1-21 the university for that purpose.
1-22 (d) A medical services fee charged under this section may be
1-23 used only to provide medical services to students registered at the
1-24 university.
2-1 (e) [(d)] The fee imposed under this section may not be
2-2 considered in determining the maximum student services fee that may
2-3 be charged students enrolled at the university under Section
2-4 54.503(b) [of this code].
2-5 (f) The maximum fee amounts imposed by Subsection (a) and
2-6 the prohibition imposed by Subsection (c) do not apply to the 2001
2-7 fall semester. For the 2001 fall semester, the board may not
2-8 increase the amount of the medical services fee to an amount more
2-9 than $30. This subsection expires January 1, 2002.
2-10 SECTION 2. The change in law made by this Act applies
2-11 beginning with fees charged for the 2001 fall semester. Fees
2-12 charged for a semester or session before the 2001 fall semester are
2-13 governed by the law in effect at the time the fees are charged, and
2-14 that law is continued in effect for that purpose.
2-15 SECTION 3. This Act takes effect immediately if it receives a
2-16 vote of two-thirds of all the members elected to each house, as
2-17 provided by Section 39, Article III, Texas Constitution. If this
2-18 Act does not receive the vote necessary for immediate effect, this
2-19 Act takes effect September 1, 2001.
