1-7 AN ACT
1-8 relating to the authority of the board of regents of the University
1-9 of North Texas to levy student fees for medical services.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 54.5081, Education Code, is amended to
1-12 read as follows:
1-13 Sec. 54.5081. MEDICAL SERVICES FEE; UNIVERSITY OF NORTH
1-14 TEXAS SYSTEM INSTITUTIONS. (a) The [governing] board of regents of
1-15 the University of North Texas System may charge each student
1-16 registered at a component institution of the University of North
1-17 Texas System [the university] a medical services fee not to exceed
1-18 $75 [$25] for each semester of the regular term or 12-week summer
1-19 session and not to exceed $37.50 [$12.50] for each six-week or
1-20 shorter term of the summer session.
1-21 (b) Before charging a medical services fee at a component
1-22 institution, the board must give students and administrators an
1-23 opportunity to offer recommendations to the board as to the type
1-24 and scope of medical services that should be provided.
1-25 (c) The board may not increase the amount of the medical
1-26 services fee charged at a component institution by more than 10
1-27 percent from one academic year to the next unless the amount of the
1-28 increase is approved by a majority of the students at the
1-29 institution voting in a general election held at the institution
1-30 for that purpose.
1-31 (d) A medical services fee charged at a component
1-32 institution of the University of North Texas System under this
1-33 section may be used only to provide medical services to students
1-34 registered at that component institution [the university].
1-35 (e) [(d)] The fee imposed under this section may not be
1-36 considered in determining the maximum student services fee that may
1-37 be charged students enrolled at a component institution of the
1-38 University of North Texas System [the university] under Section
1-39 54.503(b) [of this code].
1-40 (f) The maximum fee amounts imposed by Subsection (a) and
1-41 the prohibition imposed by Subsection (c) do not apply to the 2001
1-42 fall semester. For the 2001 fall semester, the board may not
1-43 increase the amount of the medical services fee charged at a
1-44 component institution of the University of North Texas System to an
1-45 amount more than $30 unless the increase is approved by a majority
1-46 of the students at the institution voting in an election held for
1-47 that purpose. This subsection expires January 1, 2002.
1-48 SECTION 2. The change in law made by this Act applies
1-49 beginning with fees charged for the 2001 fall semester. Fees
1-50 charged for a semester or session before the 2001 fall semester are
1-51 governed by the law in effect at the time the fees are charged, and
1-52 that law is continued in effect for that purpose.
1-53 SECTION 3. This Act takes effect immediately if it receives a
1-54 vote of two-thirds of all the members elected to each house, as
1-55 provided by Section 39, Article III, Texas Constitution. If this
1-56 Act does not receive the vote necessary for immediate effect, this
1-57 Act takes effect September 1, 2001.
