 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the authority of the board of regents of Texas Woman's
1-11     University to levy student fees for medical services.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Sections 54.5085(a) and (b), Education Code, are
1-14     amended to read as follows:
1-15           (a)  The board of regents of Texas Woman's University may
1-16     charge each student registered at the university a medical services
1-17     fee not to exceed $55 [$30] for each semester of the regular term
1-18     or 12-week summer session and not to exceed $25 [$15] for each
1-19     six-week or shorter term of the summer session.
1-20           (b)  Before the board imposes or increases a fee under this
1-21     section, the board shall consider the recommendations of a student
1-22     fee advisory committee established by the president of the
1-23     university.  A majority of the members of the advisory committee
1-24     must be students appointed by the presiding officer of the student
1-25     governing body and the remainder of the members must be appointed
1-26     by the president of the university.  The board may increase the
1-27     amount of the fee by an amount that is more than 10 percent of the
1-28     amount imposed in the preceding academic year only if that increase
1-29     is approved by a majority vote of those students of the university
1-30     participating in a general election called for that purpose.
1-31           SECTION 2.  The change in law made by this Act applies
1-32     beginning with fees charged for the 2001 fall semester. Fees
1-33     charged for a semester or session before the 2001 fall semester are
1-34     governed by the law in effect at the time the fees are charged, and
1-35     that law is continued in effect for that purpose.
1-36           SECTION 3.  This Act takes effect immediately if it receives
1-37     a vote of two-thirds of all the members elected to each house, as
1-38     provided by Section 39, Article III, Texas Constitution.  If this
1-39     Act does not receive the vote necessary for immediate effect, this
1-40     Act takes effect September 1, 2001.
