 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the definition of a junked vehicle under the public
 1-9     nuisance law.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 683.071, Transportation Code, is amended
1-12     to read as follows:
1-13           Sec. 683.071.  DEFINITION.  In this subchapter, "junked
1-14     vehicle" means a vehicle that is self-propelled and:
1-15                 (1)  does not have lawfully attached to it:
1-16                       (A)  an unexpired license plate; or
1-17                       (B)  a valid motor vehicle inspection
1-18     certificate; and
1-19                 (2)  is:
1-20                       (A)  wrecked, dismantled or partially dismantled,
1-21     or discarded; or
1-22                       (B)  [(3)  is] inoperable and has remained
1-23     inoperable for more than:
1-24                             (i) [(A)]  72 consecutive hours, if the
1-25     vehicle is on public property; or
1-26                             (ii) [(B)]  30 consecutive days, if the
1-27     vehicle is on private property.
1-28           SECTION 2. This Act takes effect September 1, 2001.
