                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the tuition charged certain foreign students attending
 1-3     a public junior college.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 54.060, Education Code, is amended by
 1-6     amending Subsection (g) and adding Subsection (h) to read as
 1-7     follows:
 1-8           (g)  In this section, "public junior college" and "public
 1-9     technical institute" have [has] the meanings [meaning] assigned by
1-10     Section 61.003 of this code.
1-11           (h)  The governing board of a junior college district may
1-12     waive the foreign student tuition prescribed by this chapter for a
1-13     student who is a resident of the United Mexican States, who
1-14     registers for lower division courses at a public junior college
1-15     operated by the district, and who demonstrates a financial need
1-16     after the financial resources of the foreign student and the
1-17     student's family are considered.  A foreign student for whom the
1-18     junior college district waives the foreign student tuition under
1-19     this subsection shall pay tuition at the rate charged Texas
1-20     residents who reside outside the junior college district.  The
1-21     Texas Higher Education Coordinating Board shall adopt rules
1-22     governing the determination of financial need of students under
1-23     this subsection.
1-24           SECTION 2.  (a)  This Act takes effect immediately if it
 2-1     receives a vote of two-thirds of all the members elected to each
 2-2     house, as provided by Section 39, Article III, Texas Constitution.
 2-3     If this Act does not receive the vote necessary for immediate
 2-4     effect, this Act takes effect September 1, 2001.
 2-5           (b)  The change in law made by this Act applies beginning
 2-6     with tuition charged for the 2001 fall semester.
