1-1 AN ACT
1-2 relating to recording information concerning appointment of certain
1-3 visiting judges.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 25.0018, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 25.0018. RECORD. (a) When a retired or former judge is
1-8 appointed as a visiting judge, the clerk shall enter in the
1-9 administrative file [minutes] as a part of the proceedings in the
1-10 cause a record that gives the visiting judge's name and shows that:
1-11 (1) the judge of the court was disqualified, absent,
1-12 or disabled to try the cause;
1-13 (2) the visiting judge was appointed; and
1-14 (3) the oath of office prescribed by law for a retired
1-15 or former judge who is appointed as a visiting judge was duly
1-16 administered to the visiting judge and filed with the regional
1-17 presiding judge.
1-18 (b) "Administrative file" means a file kept by the court
1-19 clerk for the court's administrative orders and assigned a cause
1-20 number.
1-21 SECTION 2. Section 25.00221(e), Government Code, as added by
1-22 Chapter 960, Acts of the 76th Legislature, Regular Session, 1999,
1-23 is amended to read as follows:
1-24 (e) When a retired or former judge is appointed as a
2-1 visiting judge, the clerk shall enter in the administrative file
2-2 [minutes] as a part of the proceedings in the cause a record that
2-3 gives the visiting judge's name and shows that:
2-4 (1) the judge of the court was disqualified, absent,
2-5 or disabled to try the cause;
2-6 (2) the visiting judge was appointed; and
2-7 (3) the oath of office prescribed by law for a retired
2-8 or former judge who is appointed as a visiting judge was duly
2-9 administered to the visiting judge and filed with the presiding
2-10 judge.
2-11 SECTION 3. Section 25.00221, Government Code, as added by
2-12 Chapter 960, Acts of the 76th Legislature, Regular Session, 1999,
2-13 is amended by adding Subsection (f) to read as follows:
2-14 (f) "Administrative file" means a file kept by the court
2-15 clerk for the court's administrative orders and assigned a cause
2-16 number.
2-17 SECTION 4. This Act takes effect September 1, 2001.
2-18 SECTION 5. The change in law made by this Act applies only
2-19 to the assignment of a retired or former judge made on or after the
2-20 effective date of this Act. An assignment made before the effective
2-21 date of this Act is governed by the law in effect at the time the
2-22 assignment was made, and that law is continued in effect for that
2-23 purpose.
