 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to recording information concerning appointment of certain
 1-9     visiting judges.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 25.0018, Government Code, is amended to
1-12     read as follows:
1-13           Sec. 25.0018.  RECORD. (a) When a retired or former judge is
1-14     appointed as a visiting judge, the clerk shall enter in the
1-15     administrative file [minutes] as a part of the proceedings in the
1-16     cause a record that gives the visiting judge's name and shows that:
1-17                 (1)  the judge of the court was disqualified, absent,
1-18     or disabled to try the cause;
1-19                 (2)  the visiting judge was appointed; and
1-20                 (3)  the oath of office prescribed by law for a retired
1-21     or former judge who is appointed as a visiting judge was duly
1-22     administered to the visiting judge and filed with the regional
1-23     presiding judge.
1-24           (b)  "Administrative file" means a file kept by the court
1-25     clerk for the court's administrative orders and assigned a cause
1-26     number.
1-27           SECTION 2.  Section 25.00221(e), Government Code, as added by
1-28     Chapter 960, Acts of the 76th Legislature, Regular Session, 1999,
1-29     is amended to read as follows:
1-30           (e)  When a retired or former judge is appointed as a
1-31     visiting judge, the clerk shall enter in the administrative file
1-32     [minutes] as a part of the proceedings in the cause a record that
1-33     gives the visiting judge's name and shows that:
1-34                 (1)  the judge of the court was disqualified, absent,
1-35     or disabled to try the cause;
1-36                 (2)  the visiting judge was appointed; and
1-37                 (3)  the oath of office prescribed by law for a retired
1-38     or former judge who is appointed as a visiting judge was duly
1-39     administered to the visiting judge and filed with the presiding
1-40     judge.
1-41           SECTION 3.  Section 25.00221, Government Code, as added by
1-42     Chapter 960, Acts of the 76th Legislature, Regular Session, 1999,
1-43     is amended by adding Subsection (f) to read as follows:
1-44           (f)  "Administrative file" means a file kept by the court
1-45     clerk for the court's administrative orders and assigned a cause
1-46     number.
1-47           SECTION 4.  This Act takes effect September 1, 2001.
1-48           SECTION 5.  The change in law made by this Act applies only
1-49     to the assignment of a retired or former judge made on or after the
1-50     effective date of this Act. An assignment made before the effective
1-51     date of this Act is governed by the law in effect at the time the
1-52     assignment was made, and that law is continued in effect for that
1-53     purpose.
