No. 537 77R1309 KLA-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transfer of certain causes of action by a statutory 1-3 probate court. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 25.00221(b), Government Code, as added by 1-6 Chapter 71, Acts of the 76th Legislature, Regular Session, 1999, is 1-7 amended to read as follows: 1-8 (b) If the judge of a statutory probate court that has 1-9 jurisdiction over a cause of action appertaining to or incident to 1-10 an estate pending in the statutory probate court determines that 1-11 the court no longer has jurisdiction over the cause of action, the 1-12 judge may transfer that cause of action to: 1-13 (1) a district court, county court, statutory county 1-14 court, or justice court located in the same county that has 1-15 jurisdiction over the cause of action that is transferred; or 1-16 (2) the court from which the cause of action was 1-17 transferred to the statutory probate court under Section 5B or 608, 1-18 Texas Probate Code. 1-19 SECTION 2. (a) This Act takes effect September 1, 2001. 1-20 (b) The change in law made by this Act to Section 1-21 25.00221(b), Government Code, as added by Chapter 71, Acts of the 1-22 76th Legislature, Regular Session, 1999, applies only to a cause 1-23 of action filed on or after the effective date of this Act.
