 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the transfer of certain causes of action by a statutory
 1-9     probate court.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 25.00221(b), Government Code, as added by
1-12     Chapter 71, Acts of the 76th Legislature, Regular Session, 1999, is
1-13     amended to read as follows:
1-14           (b)  If the judge of a statutory probate court that has
1-15     jurisdiction over a cause of action appertaining to or incident to
1-16     an estate pending in the statutory probate court determines that
1-17     the court no longer has jurisdiction over the cause of action, the
1-18     judge may transfer that cause of action to:
1-19                 (1)  a district court, county court, statutory county
1-20     court, or justice court located in the same county that has
1-21     jurisdiction over the cause of action that is transferred; or
1-22                 (2)  the court from which the cause of action was
1-23     transferred to the statutory probate court under Section 5B or 608,
1-24     Texas Probate Code.
1-25           SECTION 2. (a)  This Act takes effect September 1, 2001.
1-26           (b)  The change in law made by this Act to Section
1-27     25.00221(b), Government Code, as added by Chapter 71, Acts of the
1-28     76th Legislature, Regular Session, 1999,  applies only to a cause
1-29     of action filed on or after the effective date of this Act.
