No. 558 77R3081 KEL-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to restitution paid by a defendant to a children's 1-3 advocacy center providing services to the defendant's victim. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Article 42.037, Code of Criminal Procedure, is 1-6 amended by adding Subsection (o) to read as follows: 1-7 (o) In addition to any other restitution order under this 1-8 article, the court may order the defendant to pay restitution to a 1-9 children's advocacy center established under Subchapter E, Chapter 1-10 264, Family Code, that provided services to the victim. To be 1-11 eligible to receive restitution under this subsection, a children's 1-12 advocacy center must provide the court with sufficient 1-13 documentation to establish: 1-14 (1) actual provision of services to the victim; and 1-15 (2) actual cost of those services. 1-16 SECTION 2. The change in law made by this Act to Article 1-17 42.037, Code of Criminal Procedure, applies only to an order of 1-18 restitution issued on or after the effective date of this Act. 1-19 SECTION 3. This Act takes effect September 1, 2001.
