                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to creating an offense for the unlawful possession of a
 1-3     firearm by a person subject to an active protective order.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 46, Penal Code, is amended by adding
 1-6     Section 46.041 to read as follows:
 1-7           Sec. 46.041.  UNLAWFUL POSSESSION OF FIREARM BY PERSON
 1-8     SUBJECT TO ACTIVE PROTECTIVE ORDER. (a)  In this section, "active
 1-9     protective order" has the meaning assigned by Section 46.06(b)(2). 
1-10           (b)  A person commits an offense if the person possesses a
1-11     firearm while an active protective order is directed to the person.
1-12           (c)  An offense under this section is a state jail felony.
1-13           SECTION 2.  This Act takes effect September 1, 2001.
