 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to the authority of a municipality to permit the use of
1-10     unmarked automobiles by certain municipal code enforcement
1-11     officers.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1. Section 721.005(a), Transportation Code, is
1-14     amended to read as follows:
1-15           (a)  The governing body of a municipality may exempt from the
1-16     requirements of Section 721.004 an automobile when used to perform
1-17     an official duty by a:
1-18                 (1)  police department;
1-19                 (2)  magistrate as defined by Article 2.09, Code of
1-20     Criminal Procedure; [or]
1-21                 (3)  medical examiner; or
1-22                 (4)  municipal code enforcement officer designated to
1-23     enforce environmental criminal laws.
1-24           SECTION 2.  This Act takes effect immediately if it receives
1-25     a vote of two-thirds of all the members elected to each house, as
1-26     provided by Section 39, Article III, Texas Constitution.  If this
1-27     Act does not receive the vote necessary for immediate effect, this
1-28     Act takes effect September 1, 2001.
