77R11234 YDB-D By Turner of Harris H.B. No. 640 Substitute the following for H.B. No. 640: By Coleman C.S.H.B. No. 640 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the authority of the Texas Department of Health 1-3 regarding sanitation in public school restrooms. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 341.065, Health and Safety Code, is 1-6 amended by adding Subsections (f)-(h) to read as follows: 1-7 (f) The department shall adopt reasonable rules regarding 1-8 sanitation in public school restrooms. The rules must require at a 1-9 minimum that students have access to: 1-10 (1) hand cleaner; 1-11 (2) a sanitary method to dry hands; and 1-12 (3) running water. 1-13 (g) The department shall send any rules proposed under 1-14 Subsection (f) to the Texas Education Agency for review and 1-15 comment. 1-16 (h) The department or local health department shall inspect 1-17 each public school for compliance with the rules adopted under 1-18 Subsection (f) at least once every three years. 1-19 SECTION 2. The Texas Department of Health shall allow school 1-20 districts reasonable time to comply with the rules adopted under 1-21 Section 341.065, Health and Safety Code, as amended by this Act. 1-22 SECTION 3. This Act takes effect September 1, 2001.
