A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the amount of hazardous duty pay for certain state
1-3 employees.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 659.062, Government Code, is amended by
1-6 amending Subsection (a) and adding Subsection (f) to read as
1-7 follows:
1-8 (a) An eligible employee is entitled to monthly hazardous
1-9 duty pay based on the number of years [of $7 a month for each year]
1-10 of service as an employee of this state in a position that requires
1-11 the performance of hazardous duty[, not to exceed 30 years of such
1-12 service]. An eligible employee is entitled to hazardous duty pay
1-13 according to the following schedule:
1-14 (1) employees who have less than five years of state
1-15 hazardous duty service are entitled to hazardous duty pay of $10 a
1-16 month;
1-17 (2) employees who have at least 5 years but less than
1-18 10 years of state hazardous duty service are entitled to hazardous
1-19 duty pay of $15 a month;
1-20 (3) employees who have at least 10 years but less than
1-21 15 years of state hazardous duty service are entitled to hazardous
1-22 duty pay of $20 a month; and
1-23 (4) employees who have 15 or more years of state
1-24 hazardous duty service are entitled to hazardous duty pay of $25 a
2-1 month [Except as provided by Subsection (c) or Section
2-2 659.063(b)(1), this hazardous duty pay is instead of other
2-3 hazardous duty or longevity pay].
2-4 (f) Except as provided by Subsection (c) or Section
2-5 659.063(b)(1), the hazardous duty pay provided by this section is
2-6 instead of other hazardous duty or longevity pay.
2-7 SECTION 2. This Act takes effect September 1, 2001.
