No. 674 1-2 (In the Senate - Received from the House May 9, 2001; 1-3 May 10, 2001, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 11, 2001, reported favorably by 1-5 the following vote: Yeas 5, Nays 0; May 11, 2001, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to stopping, standing, or parking a vehicle on a sidewalk. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 545.302, Transportation Code, is amended 1-12 by adding Subsection (h) to read as follows: 1-13 (h) If the governing body of a municipality or county 1-14 determines that it is necessary, the governing body may adopt an 1-15 ordinance or order allowing an operator to stop, stand, or park a 1-16 passenger car or light truck on a portion of a sidewalk that 1-17 extends across a private driveway if the driveway is not long 1-18 enough to permit the stopping, standing, or parking of the 1-19 passenger car or light truck on the driveway without stopping, 1-20 standing, or parking on the sidewalk. To the extent of any 1-21 conflict between the ordinance or order and Subsection (a)(2), the 1-22 ordinance or order prevails. 1-23 SECTION 2. This Act takes effect immediately if it receives 1-24 a vote of two-thirds of all the members elected to each house, as 1-25 provided by Section 39, Article III, Texas Constitution. If this 1-26 Act does not receive the vote necessary for immediate effect, this 1-27 Act takes effect September 1, 2001. 1-28 * * * * *
