A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to compensation for public school classroom teachers and
1-3 full-time public school librarians, counselors, and nurses for
1-4 additional days of service.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 21.402, Education Code, is amended by
1-7 amending Subsections (a) and (h) and adding Subsection (i) to read
1-8 as follows:
1-9 (a) Except as provided by Subsection (d), (e), [or] (f), or
1-10 (h), a school district must pay each classroom teacher, full-time
1-11 librarian, full-time counselor certified under Subchapter B, or
1-12 full-time school nurse not less than the minimum monthly salary,
1-13 based on the employee's level of experience, determined by the
1-14 following formula:
1-15 MS = SF X FS
1-16 where:
1-17 "MS" is the minimum monthly salary;
1-18 "SF" is the applicable salary factor specified by Subsection
1-19 (c); and
1-20 "FS" is the amount, as determined by the commissioner under
1-21 Subsection (b), of state and local funds per weighted student
1-22 available to a district eligible to receive state assistance under
1-23 Section 42.302 with an enrichment tax rate, as defined by Section
1-24 42.302, equal to the maximum rate authorized under Section 42.303.
2-1 (h) The minimum monthly salary of a classroom teacher,
2-2 full-time librarian, full-time counselor certified under Subchapter
2-3 B, or full-time school nurse in a school district that requires
2-4 more than the minimum number of days of service required under
2-5 Section 21.401 is an amount equal to the minimum monthly salary
2-6 determined under this section multiplied by a fraction, the
2-7 numerator of which is the number of days of service required under
2-8 Section 21.401 plus the number of additional days required by the
2-9 district and the denominator of which is the minimum number of days
2-10 of service required under Section 21.401.
2-11 (i) In this section, "gross monthly salary" must include the
2-12 amount a teacher or librarian received that represented a career
2-13 ladder salary supplement under Section 16.057, as that section
2-14 existed January 1, 1993.
2-15 SECTION 2. This Act applies beginning with the 2000-2001
2-16 school year.
2-17 SECTION 3. This Act takes effect immediately if it receives a
2-18 vote of two-thirds of all the members elected to each house, as
2-19 provided by Section 39, Article III, Texas Constitution. If this
2-20 Act does not receive the vote necessary for immediate effect, this
2-21 Act takes effect September 1, 2001.
