No. 744 77R367 DRH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to requiring a voter to present proof of identification. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Sections 63.001(b) and (d), Election Code, are 1-5 amended to read as follows: 1-6 (b) On offering to vote, a voter must present the voter's 1-7 voter registration certificate and proof of identification in a 1-8 form described by Section 63.0101 to an election officer at the 1-9 polling place. 1-10 (d) If the voter's name is on the precinct list of 1-11 registered voters and the voter's identity can be verified from the 1-12 proof presented, the voter shall be accepted for voting. 1-13 SECTION 2. Section 63.006(a), Election Code, is amended to 1-14 read as follows: 1-15 (a) A voter who, when offering to vote, presents a voter 1-16 registration certificate indicating that the voter is currently 1-17 registered in the precinct in which the voter is offering to vote, 1-18 but whose name is not on the precinct list of registered voters, 1-19 shall be accepted for voting if the voter's identity can be 1-20 verified from the proof presented. 1-21 SECTION 3. Section 63.007(a), Election Code, is amended to 1-22 read as follows: 1-23 (a) A voter who, when offering to vote, presents a voter 1-24 registration certificate indicating that the voter is currently 2-1 registered in a different precinct from the one in which the voter 2-2 is offering to vote, and whose name is not on the precinct list of 2-3 registered voters, shall be accepted for voting if the voter's 2-4 identity can be verified from the proof presented and the voter 2-5 executes an affidavit stating that the voter: 2-6 (1) is a resident of the precinct in which the voter 2-7 is offering to vote or is otherwise entitled by law to vote in that 2-8 precinct; 2-9 (2) was a resident of the precinct in which the voter 2-10 is offering to vote at the time that information on the voter's 2-11 residence address was last provided to the voter registrar; 2-12 (3) did not deliberately provide false information to 2-13 secure registration in a precinct in which the voter does not 2-14 reside; and 2-15 (4) is voting only once in the election. 2-16 SECTION 4. This Act takes effect September 1, 2001.
