 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the fees imposed in certain child support cases.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1. Section 158.503, Family Code, is amended by adding
1-11     Subsection (d) to read as follows:
1-12           (d)  The clerk of the court may charge a reasonable fee not
1-13     to exceed $15 for filing an administrative writ under this section.
1-14           SECTION 2. Section 231.202, Family Code, is amended to read
1-15     as follows:
1-16           Sec. 231.202.  AUTHORIZED COSTS AND FEES IN TITLE IV-D CASES.
1-17     In a Title IV-D case filed under this title, the Title IV-D agency
1-18     shall pay:
1-19                 (1)  filing fees and fees for issuance and service of
1-20     process as provided by Chapter 110 of this code and by Sections
1-21     51.317,  51.318(b)(2), and 51.319(2), Government Code;
1-22                 (2)  fees for transfer as provided by Chapter 110;
1-23                 (3)  fees for the issuance and delivery of orders and
1-24     writs of income withholding in the amounts provided by Chapter 110;
1-25     [and]
1-26                 (4)  a fee of $45 for each item of process to each
1-27     individual on whom service is required, including service by
1-28     certified or registered mail, to be paid to a sheriff, constable,
1-29     or clerk whenever service of process is required; and
1-30                 (5)  the fee for filing an administrative writ of
1-31     withholding under Section 158.503(d).
1-32           SECTION 3. This Act takes effect September 1, 2001, and
1-33     applies only to a Title IV-D case filed on or after that date.  A
1-34     Title IV-D case filed before the effective date of this Act is
1-35     governed by the law in effect on the date the action was filed, and
1-36     the former law is continued in effect for that purpose.
