1-1 AN ACT
1-2 relating to the establishment of a line of vegetation along the
1-3 Gulf of Mexico in certain areas of public beach.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 61.017, Natural Resources Code, is amended
1-6 by adding Subsection (d) to read as follows:
1-7 (d)(1) In an area of public beach where a combination stone
1-8 revetment and concrete sheet pile wall constructed in its entirety
1-9 as a single structure before 1999 and continuously maintained with
1-10 a height of not less than five feet above mean low tide interrupts
1-11 the natural line of vegetation for a distance not less than 7.5
1-12 miles and not more than 8.5 miles, the line of vegetation is along
1-13 the landward boundary of that strip of land coveyed to the United
1-14 States of America for the construction of the stone revetment and
1-15 concrete sheet pile wall and for the distance marked by the stone
1-16 revetment and concrete sheet pile wall.
1-17 (2) A line of vegetation established as described by
1-18 this subsection is the landward boundary of the public beach and of
1-19 the public easement for all purposes. Fee title to all submerged
1-20 land as described in this code shall remain in the State of Texas.
1-21 SECTION 2. This Act takes effect September 1, 2001.
