No. 779 1-2 (In the Senate - Received from the House May 9, 2001; 1-3 May 10, 2001, read first time and referred to Committee on Natural 1-4 Resources; May 11, 2001, reported favorably by the following vote: 1-5 Yeas 6, Nays 0; May 11, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the establishment of a line of vegetation along the 1-9 Gulf of Mexico in certain areas of public beach. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 61.017, Natural Resources Code, is amended 1-12 by adding Subsection (d) to read as follows: 1-13 (d)(1) In an area of public beach where a combination stone 1-14 revetment and concrete sheet pile wall constructed in its entirety 1-15 as a single structure before 1999 and continuously maintained with 1-16 a height of not less than five feet above mean low tide interrupts 1-17 the natural line of vegetation for a distance not less than 7.5 1-18 miles and not more than 8.5 miles, the line of vegetation is along 1-19 the landward boundary of that strip of land coveyed to the United 1-20 States of America for the construction of the stone revetment and 1-21 concrete sheet pile wall and for the distance marked by the stone 1-22 revetment and concrete sheet pile wall. 1-23 (2) A line of vegetation established as described by 1-24 this subsection is the landward boundary of the public beach and of 1-25 the public easement for all purposes. Fee title to all submerged 1-26 land as described in this code shall remain in the State of Texas. 1-27 SECTION 2. This Act takes effect September 1, 2001. 1-28 * * * * *
