No. 804 77R1434 BDH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the period of service of the directors of legislative 1-3 agencies. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 321.005(c), Government Code, is amended 1-6 to read as follows: 1-7 (c) The State Auditor serves at the will of the committee 1-8 and for a two-year period beginning January 1 of each odd-numbered 1-9 year. The committee shall meet after September 1 and before 1-10 December 31 of each even-numbered year and must either reappoint 1-11 the State Auditor or appoint another person to serve in that 1-12 position for the following two-year period. 1-13 SECTION 2. Section 322.004(a), Government Code, is amended 1-14 to read as follows: 1-15 (a) The board shall appoint a director to serve at the 1-16 pleasure of the board and for a two-year period beginning January 1 1-17 of each odd-numbered year. The board shall meet after September 1 1-18 and before December 31 of each even-numbered year and must either 1-19 reappoint the director or appoint another person to serve in that 1-20 position for the following two-year period. The director is 1-21 accountable only to the board. 1-22 SECTION 3. Chapter 323, Government Code, is amended by 1-23 adding Section 323.002 to read as follows: 1-24 Sec. 323.002. EXECUTIVE DIRECTOR. The council shall appoint 2-1 an executive director to serve at the will of the council and for a 2-2 two-year period beginning January 1 of each odd-numbered year. The 2-3 council shall meet after September 1 and before December 31 of each 2-4 even-numbered year and must either reappoint the executive director 2-5 or appoint another person to serve in that position for the 2-6 following two-year period. 2-7 SECTION 4. Section 324.005(a), Government Code, is amended to 2-8 read as follows: 2-9 (a) The board shall appoint a director to serve at the 2-10 pleasure of the board and for a two-year period beginning January 1 2-11 of each odd-numbered year. The board shall meet after September 1 2-12 and before December 31 of each even-numbered year and must either 2-13 reappoint the director or appoint another person to serve in that 2-14 position for the following two-year period. 2-15 SECTION 5. Section 325.004(a), Government Code, is amended to 2-16 read as follows: 2-17 (a) The commission shall employ an executive director to act 2-18 as the executive head of the commission. The executive director 2-19 serves for a two-year period beginning January 1 of each 2-20 odd-numbered year. The commission shall meet after September 1 and 2-21 before December 31 of each even-numbered year and must either 2-22 reappoint the executive director or appoint another person to 2-23 serve in that position for the following two-year period. 2-24 SECTION 6. (a) This Act takes effect September 1, 2001. 2-25 (b) The state auditor and the directors of the Legislative 2-26 Budget Board, the Texas Legislative Council, the Legislative 2-27 Reference Library, and the Sunset Advisory Commission who are 3-1 serving on the effective date of this Act: 3-2 (1) may continue to serve for a period ending December 3-3 31, 2002, subject to the will of the governing body of the 3-4 legislative agency; and 3-5 (2) may be reappointed to their positions.
