1-1 AN ACT 1-2 relating to cardiopulmonary resuscitation instruction for public 1-3 school students. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 7, Education Code, is 1-6 amended by adding Section 7.025 to read as follows: 1-7 Sec. 7.025. DONATIONS FOR USE RELATED TO CARDIOPULMONARY 1-8 RESUSCITATION (CPR) INSTRUCTION. (a) The agency may accept 1-9 donations, including donations of equipment, for use in providing 1-10 cardiopulmonary resuscitation (CPR) instruction to students. The 1-11 agency: 1-12 (1) shall distribute the donations to school districts 1-13 that provide CPR instruction to students under Section 29.903; and 1-14 (2) may use a portion of the donations to the extent 1-15 necessary to pay administrative expenses related to the donations. 1-16 (b) The commissioner may adopt rules as necessary to 1-17 implement this section. 1-18 SECTION 2. Subchapter Z, Chapter 29, Education Code, is 1-19 amended by adding Section 29.903 to read as follows: 1-20 Sec. 29.903. CARDIOPULMONARY RESUSCITATION (CPR) 1-21 INSTRUCTION; DONATIONS TO SCHOOL DISTRICTS FOR USE IN CPR 1-22 INSTRUCTION. (a) A school district that provides instruction to 1-23 students in the principles and techniques of cardiopulmonary 1-24 resuscitation (CPR) may accept from the agency donations the agency 2-1 receives under Section 7.025. The district must use those 2-2 donations in providing instruction to students in the principles 2-3 and techniques of CPR. A district may accept other donations, 2-4 including donations of equipment, for use in providing the 2-5 instruction. 2-6 (b) To the extent that resources are available to a school 2-7 district under Section 7.025 or this section, the district shall 2-8 provide instruction to students in the principles and techniques of 2-9 CPR. 2-10 (c) A district may use resources other than those made 2-11 available under Section 7.025 or this section to provide 2-12 instruction to students in the principles and techniques of CPR. 2-13 (d) The commissioner may adopt rules as necessary to 2-14 implement this section. 2-15 SECTION 3. It is the intent of the legislature that each 2-16 student in this state receive instruction in the principles and 2-17 techniques of cardiopulmonary resuscitation (CPR) through the 2-18 student's school district at least once at the ninth grade level or 2-19 above. Each district is strongly encouraged to aggressively pursue 2-20 donations of time, equipment, and other resources necessary to 2-21 implement this section. The CPR instruction under this section 2-22 should conform to nationally recognized guidelines on CPR 2-23 instruction. 2-24 SECTION 4. This Act takes effect immediately if it receives 2-25 a vote of two-thirds of all the members elected to each house, as 2-26 provided by Section 39, Article III, Texas Constitution.
