                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to cardiopulmonary resuscitation instruction for public
 1-3     school students and to cardiopulmonary resuscitation and first aid
 1-4     training of certain school district personnel.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 28.002(a), Education Code, is amended to
 1-7     read as follows:
 1-8           (a)  Each school district that offers kindergarten through
 1-9     grade 12 shall offer, as a required curriculum:
1-10                 (1)  a foundation curriculum that includes:
1-11                       (A)  English language arts;
1-12                       (B)  mathematics;
1-13                       (C)  science; and
1-14                       (D)  social studies, consisting of Texas, United
1-15     States, and world history, government, and geography; and
1-16                 (2)  an enrichment curriculum that includes:
1-17                       (A)  to the extent possible, languages other than
1-18     English;
1-19                       (B)  health, with specific instruction in the
1-20     principles and techniques of cardiopulmonary resuscitation given at
1-21     least once at the seventh grade level or above;
1-22                       (C)  physical education;
1-23                       (D)  fine arts;
1-24                       (E)  economics, with emphasis on the free
 2-1     enterprise system and its benefits;
 2-2                       (F)  career and technology education; and
 2-3                       (G)  technology applications.
 2-4           SECTION 2. Section 33.086, Education Code, is amended to read
 2-5     as follows:
 2-6           Sec. 33.086.  TRAINING [CERTIFICATION] IN CARDIOPULMONARY
 2-7     RESUSCITATION AND FIRST AID. (a)  A school district employee who
 2-8     serves as the head coach or chief sponsor for an extracurricular
 2-9     athletic activity, including cheerleading, sponsored or sanctioned
2-10     by a school district or the University Interscholastic League must:
2-11                 (1)  be trained [maintain and submit to the district
2-12     proof of current certification] in first aid and cardiopulmonary
2-13     resuscitation [issued] by the American Red Cross, the American
2-14     Heart Association, or another organization that provides equivalent
2-15     training; and
2-16                 (2)  submit to the district proof of that training that
2-17     is satisfactory to the district [certification].
2-18           (b)  Each school district shall adopt procedures necessary
2-19     for administering this section, including procedures for the time
2-20     and manner in which proof of training [current certification] must
2-21     be submitted.
2-22           SECTION 3.  (a)  Section 28.002(a)(2)(B), Education Code, as
2-23     amended by this Act, applies beginning with the 2001-2002 school
2-24     year.
2-25           (b)  Section 33.086, Education Code, as amended by this Act,
2-26     applies beginning January 1, 2002.
2-27           SECTION 4.  This Act takes effect immediately if it receives
 3-1     a vote of two-thirds of all the members elected to each house, as
 3-2     provided by Section 39, Article III, Texas Constitution.  If this
 3-3     Act does not receive the vote necessary for immediate effect, this
 3-4     Act takes effect September 1, 2001.
