                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the election of directors of the Clearwater Underground
 1-3     Water Conservation District.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 10, Chapter 524, Acts of the 71st
 1-6     Legislature, Regular Session, 1989, is amended to read as follows:
 1-7           Sec. 10.  METHOD OF ELECTING [ELECTION OF] DIRECTORS.  (a)
 1-8     The directors of the district shall be elected according to the
 1-9     commissioners precinct method as provided by this section.
1-10           (b)  One director shall be elected by the electors of the
1-11     entire district and one director shall be elected from each county
1-12     commissioners precinct by the electors of that precinct.
1-13           (c)  To be qualified to be a candidate for or to serve as
1-14     director at large, a person must be a registered voter in the
1-15     district.  To be a candidate for or to serve as director from a
1-16     county commissioners precinct, a person must be a registered voter
1-17     of that precinct.
1-18           (d)  A person shall indicate on the application for a place
1-19     on the ballot:
1-20                 (1)  the precinct that the person seeks to represent;
1-21     or
1-22                 (2)  that the person seeks to represent the district at
1-23     large.
1-24           (e)  After the initial election of directors, all directors
 2-1     shall be elected to serve four-year terms, except as provided by
 2-2     Subsection (f).  The terms of directors are staggered.  On the
 2-3     first Saturday in May of even-numbered years, the appropriate
 2-4     number of directors shall be elected.
 2-5           (f)  At the first election after the county commissioners
 2-6     precincts are redrawn under Section 18, Article V, Texas
 2-7     Constitution, four new directors shall be elected to represent the
 2-8     newly redrawn precincts.  The directors from precincts one and
 2-9     three shall be elected for two-year terms.  The directors from
2-10     precincts two and four shall be elected for four-year terms.  When
2-11     the directors elected from the new precincts take office, the terms
2-12     of the directors elected from the previous precincts expire.  [On
2-13     the first Saturday in May of the second year after the year in
2-14     which the district is authorized to be created at a confirmation
2-15     election, an election shall be held in the district for the
2-16     election of two directors who shall each serve two-year terms and
2-17     three directors who shall each serve four-year terms.  Thereafter,
2-18     on the same date in each subsequent second year, the appropriate
2-19     number of directors shall be elected to the board.]
2-20           SECTION 2.  If this Act takes effect before March 21, 2001:
2-21                 (1)  the Clearwater Underground Water Conservation
2-22     District may not hold an election of directors before May 2002;
2-23                 (2)  on the first Saturday in May 2002, the Clearwater
2-24     Underground Water Conservation District shall hold an election of:
2-25                       (A)  one director from the district at large, to
2-26     serve a term of four years;
2-27                       (B)  one director from Bell County Commissioners
 3-1     Court Precinct Number One, to serve a term of two years;
 3-2                       (C)  one director from Bell County Commissioners
 3-3     Court Precinct Number Two, to serve a term of four years;
 3-4                       (D)  one director from Bell County Commissioners
 3-5     Court Precinct Number Three, to serve a term of two years; and
 3-6                       (E)  one director from Bell County Commissioners
 3-7     Court Precinct Number Four, to serve a term of four years; and
 3-8                 (3)  directors of the Clearwater Underground Water
 3-9     Conservation District serving on the effective date of this Act
3-10     shall continue to serve until their successors take office
3-11     following the election under this section.
3-12           SECTION 3.  Notwithstanding Section 10(f), Chapter 524, Acts
3-13     of the 71st Legislature, Regular Session, 1989, as amended by this
3-14     Act, if this Act takes effect on or after March 21, 2001:
3-15                 (1)  on the first Saturday in May 2002, the Clearwater
3-16     Underground Water Conservation District shall hold an election of:
3-17                       (A)  one director from Bell County Commissioners
3-18     Court Precinct Number One, to serve a term of four years; and
3-19                       (B)  one director from Bell County Commissioners
3-20     Court Precinct Number Three, to serve a term of four years; and
3-21                 (2)  on the first Saturday in May 2004, the Clearwater
3-22     Underground Water Conservation District shall hold an election of:
3-23                       (A)  one director from the district at large, to
3-24     serve a term of four years;
3-25                       (B)  one director from Bell County Commissioners
3-26     Court Precinct Number Two, to serve a term of four years; and
3-27                       (C)  one director from Bell County Commissioners
 4-1     Court Precinct Number Four, to serve a term of four years.
 4-2           SECTION 4.  This Act takes effect immediately if it receives
 4-3     a vote of two-thirds of all the members elected to each house, as
 4-4     provided by Section 39, Article III, Texas Constitution.  If this
 4-5     Act does not receive the vote necessary for immediate effect, this
 4-6     Act takes effect September 1, 2001.
