                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the sale of a minor's property by a person without
 1-3     guardianship.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 889(a), Texas Probate Code, is amended to
 1-6     read as follows:
 1-7           (a)  When a minor has an interest in real or personal
 1-8     property and the net value of the [minor's] interest [in real or
 1-9     personal property in an estate] does not exceed $100,000 [$50,000],
1-10     a natural or adoptive parent, or the managing conservator, of a
1-11     minor who is not a ward may apply to the court for an order to sell
1-12     the minor's interest in the [real or personal] property [of a minor
1-13     in an estate] without being appointed guardian.  A minor may not
1-14     disaffirm a sale of property pursuant to a court order under this
1-15     section.
1-16           SECTION 2.  This Act takes effect September 1, 2001, and the
1-17     changes in law made by this Act to Section 889, Texas Probate Code,
1-18     apply only to an application filed on or after that date.  An
1-19     application filed before the effective date of this Act is governed
1-20     by the law in effect on the date the application was filed, and the
1-21     former law is continued in effect for that purpose.
