                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to waiving certain late penalties imposed on subdivisions
 1-3     that participate in the Texas County and District Retirement
 1-4     System.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 845.407, Government Code, is amended by
 1-7     adding Subsection (c) to read as follows:
 1-8           (c)  The board of trustees shall waive a penalty imposed on a
 1-9     participating subdivision under Subsection (a)  if the subdivision:
1-10                 (1)  submits evidence that the board of trustees
1-11     determines is sufficient to show that:
1-12                       (A)  the subdivision made a diligent attempt to
1-13     comply with this subchapter; and
1-14                       (B)  wilful negligence did not cause a
1-15     contribution required by this subchapter or information required by
1-16     Section 845.403 to be untimely; and
1-17                 (2)  provides the information or pays the contribution
1-18     not later than the 21st day after the date the subdivision knew or
1-19     should have known of the failure to timely provide the information
1-20     or pay the contribution.
1-21           SECTION 2.  This Act applies to a payment required under
1-22     Subchapter E, Chapter 845, Government Code, or information required
1-23     under Section 845.403, Government Code, that is due on or after
1-24     January 1, 2000.
 2-1           SECTION 3.  This Act takes effect immediately if it receives
 2-2     a vote of two-thirds of all the members elected to each house, as
 2-3     provided by Section 39, Article III, Texas Constitution.  If this
 2-4     Act does not receive the vote necessary for immediate effect, this
 2-5     Act takes effect September 1, 2001.
