                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the inclusion of certain students attending magnet
 1-3     schools in other districts in the computation of weighted average
 1-4     daily attendance of the school district in which the students
 1-5     reside.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1.  Section 41.0031, Education Code, is amended to
 1-8     read as follows:
 1-9           Sec. 41.0031.  INCLUSION OF ATTENDANCE CREDITS, [AND]
1-10     NONRESIDENTS, AND CERTAIN MAGNET SCHOOL STUDENTS IN WEIGHTED
1-11     AVERAGE DAILY ATTENDANCE. In determining whether a school district
1-12     has a wealth per student less than or equal to the equalized wealth
1-13     level, the commissioner shall use:
1-14                 (1)  the district's final weighted average daily
1-15     attendance; [and]
1-16                 (2)  the number of attendance credits a district
1-17     purchases under Subchapter D;
1-18                 (3)  [or] the number of nonresident students a district
1-19     educates under Subchapter E for a school year; and
1-20                 (4)  the average daily attendance of students who
1-21     attend a magnet school in another school district whose territory
1-22     overlaps that of the district and of other districts if the
1-23     students:
1-24                       (A)  previously attended school in the district;
 2-1     and
 2-2                       (B)  are eligible under Section 25.001(a) to
 2-3     attend school in the district.
 2-4           SECTION 2.  This Act applies beginning with the 2001-2002
 2-5     school year.
 2-6           SECTION 3.  This Act takes effect immediately if it receives
 2-7     a vote of two-thirds of all the members elected to each house, as
 2-8     provided by Section 39, Article III, Texas Constitution.  If this
 2-9     Act does not receive the vote necessary for immediate effect, this
2-10     Act takes effect September 1, 2001.
