1-1                                   AN ACT
 1-2     relating to the establishment of a flexibility rating system for
 1-3     directives sent by the Texas Workforce Commission to local
 1-4     workforce development boards.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter C, Chapter 302, Labor Code, is amended
 1-7     by adding Section 302.044 to read as follows:
 1-8           Sec. 302.044.  FLEXIBILITY RATING SYSTEM FOR COMMISSION
 1-9     DIRECTIVES.  (a)  The commission shall develop and implement a
1-10     flexibility rating system for directives sent by the commission to
1-11     local workforce development boards.  A rating assigned to a
1-12     directive under the system shall indicate the degree of flexibility
1-13     that a local workforce development board has in implementing the
1-14     directive.  The commission shall provide an explanation of the
1-15     ratings assigned under the system to each local workforce
1-16     development board.
1-17           (b)  The commission shall adopt rules as necessary to
1-18     implement this section.
1-19           SECTION 2.  (a)  This Act takes effect September 1, 2001.
1-20           (b)  The Texas Workforce Commission shall implement the
1-21     flexibility rating system prescribed by Section 302.044, Labor
1-22     Code, as added by this Act, not later than January 1, 2002.
