No. 935 1-2 (In the Senate - Received from the House April 23, 2001; 1-3 April 24, 2001, read first time and referred to Committee on 1-4 Business and Commerce; May 3, 2001, reported favorably by the 1-5 following vote: Yeas 6, Nays 0; May 3, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the establishment of a flexibility rating system for 1-9 directives sent by the Texas Workforce Commission to local 1-10 workforce development boards. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter C, Chapter 302, Labor Code, is amended 1-13 by adding Section 302.044 to read as follows: 1-14 Sec. 302.044. FLEXIBILITY RATING SYSTEM FOR COMMISSION 1-15 DIRECTIVES. (a) The commission shall develop and implement a 1-16 flexibility rating system for directives sent by the commission to 1-17 local workforce development boards. A rating assigned to a 1-18 directive under the system shall indicate the degree of flexibility 1-19 that a local workforce development board has in implementing the 1-20 directive. The commission shall provide an explanation of the 1-21 ratings assigned under the system to each local workforce 1-22 development board. 1-23 (b) The commission shall adopt rules as necessary to 1-24 implement this section. 1-25 SECTION 2. (a) This Act takes effect September 1, 2001. 1-26 (b) The Texas Workforce Commission shall implement the 1-27 flexibility rating system prescribed by Section 302.044, Labor 1-28 Code, as added by this Act, not later than January 1, 2002. 1-29 * * * * *
