A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the application of certain laws to local workforce
1-3 development boards.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 551.001(3), Government Code, is amended to
1-6 read as follows:
1-7 (3) "Governmental body" means:
1-8 (A) a board, commission, department, committee,
1-9 or agency within the executive or legislative branch of state
1-10 government that is directed by one or more elected or appointed
1-11 members;
1-12 (B) a county commissioners court in the state;
1-13 (C) a municipal governing body in the state;
1-14 (D) a deliberative body that has rulemaking or
1-15 quasi-judicial power and that is classified as a department,
1-16 agency, or political subdivision of a county or municipality;
1-17 (E) a school district board of trustees;
1-18 (F) a county board of school trustees;
1-19 (G) a county board of education;
1-20 (H) the governing board of a special district
1-21 created by law; [and]
1-22 (I) a local workforce development board created
1-23 under Section 2308.253; and
1-24 (J) a nonprofit corporation organized under
2-1 Chapter 67, Water Code, that provides a water supply or wastewater
2-2 service, or both, and is exempt from ad valorem taxation under
2-3 Section 11.30, Tax Code.
2-4 SECTION 2. Section 552.003(1), Government Code, is amended to
2-5 read as follows:
2-6 (1) "Governmental body":
2-7 (A) means:
2-8 (i) a board, commission, department,
2-9 committee, institution, agency, or office that is within or is
2-10 created by the executive or legislative branch of state government
2-11 and that is directed by one or more elected or appointed members;
2-12 (ii) a county commissioners court in the
2-13 state;
2-14 (iii) a municipal governing body in the
2-15 state;
2-16 (iv) a deliberative body that has
2-17 rulemaking or quasi-judicial power and that is classified as a
2-18 department, agency, or political subdivision of a county or
2-19 municipality;
2-20 (v) a school district board of trustees;
2-21 (vi) a county board of school trustees;
2-22 (vii) a county board of education;
2-23 (viii) the governing board of a special
2-24 district;
2-25 (ix) a local workforce development board
2-26 created under Section 2308.253;
2-27 (x) [(ix)] the governing body of a
3-1 nonprofit corporation organized under Chapter 67, Water Code, that
3-2 provides a water supply or wastewater service, or both, and is
3-3 exempt from ad valorem taxation under Section 11.30, Tax Code; and
3-4 (xi) [(x)] the part, section, or portion
3-5 of an organization, corporation, commission, committee,
3-6 institution, or agency that spends or that is supported in whole or
3-7 in part by public funds; and
3-8 (B) does not include the judiciary.
3-9 SECTION 3. Section 771.002(1), Government Code, is amended to
3-10 read as follows:
3-11 (1) "Agency" includes:
3-12 (A) a department, board, bureau, commission,
3-13 court, office, authority, council, or institution;
3-14 (B) a university, college, or any service or
3-15 part of a state institution of higher education; [and]
3-16 (C) a local workforce development board created
3-17 under Section 2308.253; and
3-18 (D) any statewide job or employment training
3-19 program for disadvantaged youth that is substantially financed by
3-20 federal funds and that was created by executive order not later
3-21 than December 30, 1986.
3-22 SECTION 4. Section 271.081, Local Government Code, is amended
3-23 to read as follows:
3-24 Sec. 271.081. DEFINITION. In this subchapter, "local
3-25 government" means a county, municipality, special district, school
3-26 district, junior college district, a local workforce development
3-27 board created under Section 2308.253, Government Code, or other
4-1 legally constituted political subdivision of the state.
4-2 SECTION 5. Section 2175.001(1), Government Code, is amended
4-3 to read as follows:
4-4 (1) "Assistance organization" means:
4-5 (A) a nonprofit organization that provides
4-6 educational, health, or human services or assistance to homeless
4-7 individuals;
4-8 (B) a nonprofit food bank that solicits,
4-9 warehouses, and redistributes edible but unmarketable food to an
4-10 agency that feeds needy families and individuals;
4-11 (C) Texas Partners of the Americas, a registered
4-12 agency with the Advisory Committee on Voluntary Foreign Aid, with
4-13 the approval of the Partners of the Alliance office of the Agency
4-14 for International Development; [and]
4-15 (D) a group, including a faith-based group, that
4-16 enters into a financial or nonfinancial agreement with a health or
4-17 human services agency to provide services to that agency's clients;
4-18 and
4-19 (E) a local workforce development board created
4-20 under Section 2308.253.
4-21 SECTION 6. Section 101.001(3), Civil Practice and Remedies
4-22 Code, is amended to read as follows:
4-23 (3) "Governmental unit" means:
4-24 (A) this state and all the several agencies of
4-25 government that collectively constitute the government of this
4-26 state, including other agencies bearing different designations, and
4-27 all departments, bureaus, boards, commissions, offices, agencies,
5-1 councils, and courts;
5-2 (B) a political subdivision of this state,
5-3 including any city, county, school district, junior college
5-4 district, levee improvement district, drainage district, irrigation
5-5 district, water improvement district, water control and improvement
5-6 district, water control and preservation district, freshwater
5-7 supply district, navigation district, conservation and reclamation
5-8 district, soil conservation district, communication district,
5-9 public health district, and river authority;
5-10 (C) a local workforce development board created
5-11 under Section 2308.253, Government Code;
5-12 (D) an emergency service organization; and
5-13 (E) [(D)] any other institution, agency, or
5-14 organ of government the status and authority of which are derived
5-15 from the Constitution of Texas or from laws passed by the
5-16 legislature under the constitution.
5-17 SECTION 7. This Act takes effect September 1, 2001.
