                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of certain counties to require water
 1-3     corporations to collect solid waste disposal service fees for the
 1-4     counties.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter C, Chapter 364, Health and Safety
 1-7     Code, is amended by adding Section 364.0345 to read as follows:
 1-8           Sec. 364.0345.  COLLECTION OF SOLID WASTE DISPOSAL SERVICE
 1-9     FEES BY WATER CORPORATIONS SERVING ECONOMICALLY DISTRESSED AREAS.
1-10     (a)  In this section, "water supply or sewer service corporation"
1-11     has the meaning assigned by Section 13.002, Water Code.
1-12           (b)  A county that is eligible for financial assistance under
1-13     Section 17.923, Water Code, may require a water supply or sewer
1-14     service corporation serving an area of the county to collect the
1-15     solid waste disposal service fees for solid waste disposal services
1-16     provided in that area by the county.  The county shall compensate
1-17     the corporation for the actual cost of collecting the fees and may
1-18     use the fees to pay the compensation.
1-19           SECTION 2.  This Act takes effect September 1, 2001.

1-21           Amend H.B. No. 987 as follows:
1-22           (1)  On page 1, line 13, strike "require" and substitute
1-23     "contract with".
1-24           (2)  On page 1, line 14, between "collect" and "the" insert
