                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the animal friendly account and advisory committee.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 828.014(b), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6           (b)  The Texas Department of Health administers the account.
 1-7     The department may spend money credited to the account only to:
 1-8                 (1)  [only after at least $500,000 has been credited to
 1-9     the account; and]
1-10                 [(2)  only to:]
1-11                       [(A)]  make grants to eligible organizations that
1-12     sterilize animals owned by the general public at minimal or no
1-13     cost; and
1-14                 (2) [(B)]  defray the cost of administering the
1-15     account.
1-16           SECTION 2. Section 828.015(d), Health and Safety Code, is
1-17     amended to read as follows:
1-18           (d)  Members of the committee serve without compensation and
1-19     are not entitled to reimbursement for expenses. Each member serves
1-20     a term of four [two] years. The terms of four members expire on
1-21     January 31 of every other [each] odd-numbered year and the terms of
1-22     the remaining members expire on January 31 of every other [each]
1-23     even-numbered year.
1-24           SECTION 3. Section 4, Chapter 657, Acts of the 75th
 2-1     Legislature, Regular Session, 1997, as amended by Section 5,
 2-2     Chapter 951, Acts of the 76th Legislature, Regular Session, 1999,
 2-3     is repealed.
 2-4           SECTION 4. This Act takes effect immediately if it receives a
 2-5     vote of two-thirds of all the members elected to each house, as
 2-6     provided by Section 39, Article III, Texas Constitution. If this
 2-7     Act does not receive the vote necessary for immediate effect, this
 2-8     Act takes effect September 1, 2001.
