1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the animal friendly account and advisory committee.
1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10 SECTION 1. Section 828.014(b), Health and Safety Code, is
1-11 amended to read as follows:
1-12 (b) The Texas Department of Health administers the account.
1-13 The department may spend money credited to the account only to:
1-14 (1) [only after at least $500,000 has been credited to
1-15 the account; and]
1-16 [(2) only to:]
1-17 [(A)] make grants to eligible organizations that
1-18 sterilize animals owned by the general public at minimal or no
1-19 cost; and
1-20 (2) [(B)] defray the cost of administering the
1-21 account.
1-22 SECTION 2. Section 828.015(d), Health and Safety Code, is
1-23 amended to read as follows:
1-24 (d) Members of the committee serve without compensation and
1-25 are not entitled to reimbursement for expenses. Members of the
1-26 committee serve staggered four-year terms with the terms of as near
1-27 one-half as possible of the members expiring [Each member serves a
1-28 term of two years. The terms of four members expire on January 31
1-29 of each odd-numbered year and the terms of the remaining members
1-30 expire] on January 31 of each even-numbered year.
1-31 SECTION 3. Section 4, Chapter 657, Acts of the 75th
1-32 Legislature, Regular Session, 1997, as amended by Section 5,
1-33 Chapter 951, Acts of the 76th Legislature, Regular Session, 1999,
1-34 is repealed.
1-35 SECTION 4. The terms of the four members of the animal
1-36 friendly advisory committee that were to expire on January 31,
1-37 2003, are extended to three-year terms and expire on January 31,
1-38 2004.
1-39 SECTION 5. This Act takes effect immediately if it receives a
1-40 vote of two-thirds of all the members elected to each house, as
1-41 provided by Section 39, Article III, Texas Constitution. If this
1-42 Act does not receive the vote necessary for immediate effect, this
1-43 Act takes effect on the 91st day after the last day of the
1-44 legislative session.
