No. 1010 77R3668 MTB-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the Texas Historical Commission's designation of a 1-3 structure or property owned by the state as a historic structure. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 442, Government Code, is amended by 1-6 adding Section 442.017 to read as follows: 1-7 Sec. 442.017. STRUCTURE OR PROPERTY OWNED BY STATE. (a) 1-8 This section applies only to a structure or property owned by the 1-9 state. 1-10 (b) The commission may not designate a structure or property 1-11 as a state archeological landmark or a Recorded Texas Historic 1-12 Landmark or take any other action that causes the structure or 1-13 property to be treated as a historic structure or a historic 1-14 property for purposes of this chapter or other law unless the 1-15 commission has the prior approval of the state governmental entity 1-16 that holds title to the structure or property in the name of the 1-17 state or that has charge and control of the structure or property 1-18 under state law. 1-19 SECTION 2. Any of the following actions taken after January 1-20 1, 2001, by the Texas Historical Commission in relation to a 1-21 structure or property owned by the state is void unless the action 1-22 was taken with the prior approval of the state governmental entity 1-23 that held title to the structure or property in the name of the 1-24 state or that had charge and control of the structure or property 2-1 under state law: 2-2 (1) a designation of a structure or property as a 2-3 state archeological landmark or a Recorded Texas Historic Landmark; 2-4 or 2-5 (2) another action that caused the structure or 2-6 property to be treated as a historic structure or a historic 2-7 property for purposes of Chapter 442, Government Code, or other 2-8 law. 2-9 SECTION 3. This Act takes effect immediately if it receives 2-10 a vote of two-thirds of all the members elected to each house, as 2-11 provided by Section 39, Article III, Texas Constitution. If this 2-12 Act does not receive the vote necessary for immediate effect, this 2-13 Act takes effect September 1, 2001.
