1-1                                   AN ACT
 1-2     relating to certain reports submitted to the community justice
 1-3     assistance division of the Texas Department of Criminal Justice on
 1-4     the use of ignition interlock devices.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 509.004(a), Government Code, is amended to
 1-7     read as follows:
 1-8           (a)  The division shall require each department to:
 1-9                 (1)  keep financial and statistical records determined
1-10     necessary by the division;
1-11                 (2)  submit a community justice plan and all supporting
1-12     information requested by the division;
1-13                 (3)  present data requested by the division as
1-14     necessary to determine the amount of state aid for which the
1-15     department is eligible;
1-16                 (4)  submit periodic financial audits and statistical
1-17     reports to the division; and
1-18                 (5)  [submit periodic data to the division on the
1-19     required use of deep-lung breath analysis mechanisms to make
1-20     impractical the operation of a motor vehicle if ethyl alcohol is
1-21     detected in the breath of the operator, including the number of
1-22     devices in use, the number of violations detected, malfunctions by
1-23     the devices, and attempts to circumvent the devices; and]
1-24                 [(6)]  submit to the Department of Public Safety the
 2-1     full name, address, date of birth, social security number, and
 2-2     driver's license number of each person restricted to the operation
 2-3     of a motor vehicle equipped with a device that uses a deep-lung
 2-4     breath analysis mechanism to make impractical the operation of the
 2-5     motor vehicle if ethyl alcohol is detected in the breath of the
 2-6     restricted operator.
 2-7           SECTION 2. This Act takes effect immediately if it receives a
 2-8     vote of two-thirds of all the members elected to each house, as
 2-9     provided by Section 39, Article III, Texas Constitution. If this
2-10     Act does not receive the vote necessary for immediate effect, this
2-11     Act takes effect September 1, 2001.
