No. 1095 77R4694 DLF-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to procedures and standards for providing health care 1-3 services in public schools. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 12, Health and Safety Code, is amended by 1-6 adding Subchapter K to read as follows: 1-7 SUBCHAPTER K. SCHOOL-BASED HEALTH CARE SERVICES 1-8 Sec. 12.171. PROCEDURES AND STANDARDS. The board by rule 1-9 shall recommend procedures and minimum standards for providing 1-10 quality health care services to school-aged children in public 1-11 elementary and secondary schools. The recommendations must identify 1-12 available appropriate funding mechanisms. 1-13 Sec. 12.172. ADVISORY COMMITTEE. (a) The board shall 1-14 appoint a school health advisory committee to assist the board in 1-15 performing its duties under this subchapter. The advisory committee 1-16 consists of the following 16 members: 1-17 (1) two physicians who provide health care services to 1-18 school-aged children; 1-19 (2) two registered nurses or physician assistants 1-20 providing health care services in public elementary or secondary 1-21 schools; 1-22 (3) two public school administrators; 1-23 (4) four members representing entities involved with 1-24 the health of school-aged children; and 2-1 (5) six public members. 2-2 (b) The public members of the school health advisory 2-3 committee must include parents of school-aged children and at least 2-4 one parent of a child with special health care needs. 2-5 (c) The advisory committee is subject to Chapter 2110, 2-6 Government Code. 2-7 Sec. 12.173. DISTRIBUTION AND CONSIDERATION OF 2-8 RECOMMENDATIONS. (a) Not less frequently than once in each state 2-9 fiscal biennium, the department shall notify each school district 2-10 in this state of the availability of the recommended procedures and 2-11 minimum standards adopted under Section 12.171. 2-12 (b) The governing body of each school district shall 2-13 consider implementing, but is not required to implement, the 2-14 procedures and minimum standards recommended under this subchapter. 2-15 SECTION 2. This Act takes effect immediately if it receives 2-16 a vote of two-thirds of all the members elected to each house, as 2-17 provided by Section 39, Article III, Texas Constitution. If this 2-18 Act does not receive the vote necessary for immediate effect, this 2-19 Act takes effect September 1, 2001.
