A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the dedication of a fine collected by a municipality or
1-3 county for a disabled parking violation.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Chapter 681, Transportation Code, is amended by
1-6 adding Section 681.013 to read as follows:
1-7 Sec. 681.013. DISPOSITION OF FINES. (a) A municipality or
1-8 county shall deposit a fine collected for a violation of Section
1-9 681.011 into a separate municipal or county fund. Money in the
1-10 fund may be used only for improving accessibility for persons with
1-11 disabilities, including providing:
1-12 (1) curb cuts;
1-13 (2) auditory alarms at crosswalks; and
1-14 (3) captioning for governmental meetings.
1-15 (b) This section does not apply to an amount that a
1-16 municipality is not allowed to retain under Section 542.402(b).
1-17 SECTION 2. Section 542.402(a), Transportation Code, is
1-18 amended to read as follows:
1-19 (a) A municipality or county shall use a fine collected for
1-20 a violation of a highway law in this title, other than a violation
1-21 of Section 681.011, to:
1-22 (1) construct and maintain roads, bridges, and
1-23 culverts in the municipality or county;
1-24 (2) enforce laws regulating the use of highways by
2-1 motor vehicles; [and]
2-2 (3) defray the expense of county traffic officers;
2-3 (4) defray the expense of captioning and personal
2-4 assistance services for a disability-related community event
2-5 sponsored by a municipality, county, or nonprofit organization; and
2-6 (5) provide technical equipment such as braille
2-7 writers and telecommunication devices for the deaf, for use by
2-8 persons with disabilities, at a municipal or county facility.
2-9 SECTION 3. This Act takes effect September 1, 2001, and
2-10 applies only to fines collected in a municipal or county fiscal
2-11 year that begins on or after that date. Fines collected in a
2-12 municipal or county fiscal year that begins before the effective
2-13 date of this Act are governed by the law in effect immediately
2-14 before the effective date of this Act, and that law is continued in
2-15 effect for that purpose.
