                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of a peace officer commissioned by a
 1-3     school district to enforce certain traffic laws in a school
 1-4     crossing zone.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Subchapter A, Chapter 543, Transportation Code, is
 1-7     amended by adding Section 543.0015 to read as follows:
 1-8           Sec. 543.0015.  ARREST WITHOUT WARRANT BY CERTAIN SCHOOL
 1-9     DISTRICT PEACE OFFICERS.  (a)  A peace officer commissioned under
1-10     Section 37.081, Education Code, may, subject to Subsection (b),
1-11     arrest without warrant a person found committing a violation of
1-12     this subtitle in a school crossing zone of a school in the district
1-13     that commissioned the officer, if the board of trustees of the
1-14     applicable school district, acting under Section 37.081(a),
1-15     Education Code, determines that:
1-16                 (1)  the jurisdiction of peace officers commissioned by
1-17     the school district includes school crossing zones; and
1-18                 (2)  enforcement of this subtitle in a school crossing
1-19     zone is within the scope of the on-duty law enforcement activities
1-20     of school district peace officers.
1-21           (b)  A peace officer commissioned by the school district may
1-22     not use a radar or laser unit to detect or measure the speed of a
1-23     motor vehicle to determine whether the operator is committing a
1-24     speeding offense under Subchapter H, Chapter 545, unless the
 2-1     officer has received training in the proper use of the radar or
 2-2     laser unit in the same manner as the training is received by:
 2-3                 (1)  a police officer of the most populous municipality
 2-4     in which the school district has territory; or
 2-5                 (2)  a sheriff's deputy of the most populous county in
 2-6     which the school district has territory, if the school district
 2-7     does not have territory in a municipality.
 2-8           SECTION 2.  This Act takes effect immediately if it receives
 2-9     a vote of two-thirds of all the members elected to each house, as
2-10     provided by Section 39, Article III, Texas Constitution.  If this
2-11     Act does not receive the vote necessary for immediate effect, this
2-12     Act takes effect September 1, 2001.
