A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to expanding access to women's health care services.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 32.024, Human Resources Code, is amended
1-5 by adding Subsection (x) to read as follows:
1-6 (x) The department shall set the income eligibility cap for
1-7 medical assistance at 185 percent of the federal poverty level for
1-8 preventive health and family planning services for women.
1-9 SECTION 2. Subchapter B, Chapter 32, Human Resources Code, is
1-10 amended by adding Section 32.0247 to read as follows:
1-11 Sec. 32.0247. IDENTIFICATION OF OTHER FUNDING SOURCES FOR
1-12 CLIENTS OF MEDICAL ASSISTANCE. The department shall compile a list
1-13 of potential funding sources a client can use to help pay for
1-14 treatment for health problems:
1-15 (1) identified using preventive health services
1-16 provided to the client under the medical assistance program; and
1-17 (2) for which the client is not eligible to receive
1-18 treatment under the program.
1-19 SECTION 3. If before implementing any provision of this Act a
1-20 state agency determines that a waiver or authorization from a
1-21 federal agency is necessary for implementation of that provision,
1-22 the agency affected by the provision shall request the waiver or
1-23 authorization and may delay implementing that provision until the
1-24 waiver or authorization is granted.
2-1 SECTION 4. This Act takes effect September 1, 2001.
