                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the punishment for the offense of attempted murder.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 15.01, Penal Code, is amended by amending
 1-5     Subsection (d) and by adding Subsection (e) to read as follows:
 1-6           (d)  Except as provided by Subsection (e), an [An] offense
 1-7     under this section is one category lower than the offense
 1-8     attempted, and if the offense attempted is a state jail felony, the
 1-9     offense is a Class A misdemeanor.
1-10           (e)  An offense under this section that is an attempt to
1-11     commit murder punishable under Section 19.02(c) is a felony
1-12     punishable by imprisonment in the Institutional Division for not
1-13     more than 40 years or less than two years.  In addition to
1-14     imprisonment, an individual punished under this subsection may be
1-15     punished by a fine not to exceed $10,000.
1-16           SECTION 2.  (a)  The change in law made by this Act applies
1-17     only to an offense committed on or after the effective date of this
1-18     Act.  For purposes of this section, an offense is committed before
1-19     the effective date of this Act if any element of the offense occurs
1-20     before the effective date.
1-21           (b)  An offense committed before the effective date of this
1-22     Act is covered by the law in effect when the offense was committed,
1-23     and the former law is continued in effect for that purpose.
1-24           SECTION 3.  This Act takes effect September 1, 2001.
