A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to installment payments of tuition and fees by a student
1-3 enrolled for a summer session at a public institution of higher
1-4 education.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Sections 54.007(a) and (b), Education Code, are
1-7 amended to read as follows:
1-8 (a) The governing board of each institution of higher
1-9 education shall permit a student to pay [provide for the payment
1-10 of] tuition and fees [during the fall and spring semesters] through
1-11 the following alternatives:
1-12 (1) for a student enrolled for any semester or term,
1-13 full payment of tuition and fees in advance of the beginning of the
1-14 semester; [or]
1-15 (2) for a student enrolled for a fall or spring
1-16 semester, one-half payment of tuition and fees in advance of the
1-17 beginning of the semester, one-quarter payment before [prior to]
1-18 the beginning [start] of the sixth class week, and the final
1-19 one-quarter payment before the beginning of the 11th [eleventh]
1-20 class week;
1-21 (3) for a student enrolled for a 12-week summer term,
1-22 one-half payment of tuition and fees in advance of the beginning of
1-23 the summer term, one-quarter payment before the beginning of the
1-24 fifth class week, and the final one-quarter payment before the
2-1 beginning of the ninth class week; or
2-2 (4) for a student enrolled for a 16-week summer term,
2-3 one-half payment of tuition and fees in advance of the beginning of
2-4 the summer term, one-quarter payment before the beginning of the
2-5 sixth class week, and the final one-quarter payment before the
2-6 beginning of the 11th class week.
2-7 (b) The governing board may assess and collect incidental
2-8 fees for students utilizing payment alternatives [alternative] (2),
2-9 (3), and (4) under Subsection (a) [of this section] and for
2-10 students delinquent in payments. The fees must reasonably reflect
2-11 the cost to the institution of handling those payments.
2-12 SECTION 2. The change in law made by this Act applies
2-13 beginning with tuition and fees charged for the 2001 fall semester.
2-14 SECTION 3. This Act takes effect immediately if it receives
2-15 a vote of two-thirds of all the members elected to each house, as
2-16 provided by Section 39, Article III, Texas Constitution. If this
2-17 Act does not receive the vote necessary for immediate effect, this
2-18 Act takes effect September 1, 2001.
