No. 1227 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the establishment of a pilot project by the Texas 1-3 Natural Resource Conservation Commission to examine benefits of 1-4 offering incentives to regulated entities to install air pollution 1-5 monitoring devices linked to the commission's data system. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. PILOT PROJECT ON INCENTIVES FOR INSTALLING 1-8 MONITORING DEVICES LINKED TO TEXAS NATURAL RESOURCE CONSERVATION 1-9 COMMISSION DATA SYSTEM. (a) The Texas Natural Resource 1-10 Conservation Commission shall establish and conduct a pilot project 1-11 to determine the value and feasibility of offering to entities 1-12 regulated under Chapter 382, Health and Safety Code, incentives to 1-13 install fence-line and smokestack air pollution monitoring devices 1-14 and link the devices with the commission's data system. 1-15 (b) The Texas Natural Resource Conservation Commission may 1-16 consider offering, and shall collect data on the value and 1-17 feasibility of offering incentives including, to the extent 1-18 consistent with federal requirements: 1-19 (1) on-site technical assistance; 1-20 (2) expedited permitting; 1-21 (3) reduced reporting and recordkeeping requirements; 1-22 and 1-23 (4) reduced inspections. 1-24 SECTION 2. REPORT TO LEGISLATURE. Not later than December 1, 2-1 2002, the Texas Natural Resource Conservation Commission shall 2-2 report the results of the project to the legislature. 2-3 SECTION 3. EFFECTIVE DATE. This Act takes effect September 2-4 1, 2001.
