                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of incentives by the Texas Natural
 1-3     Resource Conservation Commission for regulated entities to install
 1-4     air pollution monitoring devices linked to the commission's data
 1-5     system.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1. Subchapter B, Chapter 382, Health and Safety Code,
 1-8     is amended by adding Section 382.0165 to read as follows:
 1-9           Sec. 382.0165.  INCENTIVES FOR INSTALLING MONITORING DEVICES
1-10     LINKED TO COMMISSION DATA SYSTEM. (a)  The commission shall offer
1-11     to entities regulated under this chapter incentives to install
1-12     fence-line and smokestack air pollution monitoring devices and link
1-13     the devices with the commission's data system.
1-14           (b)  Incentives offered under this section may include, to
1-15     the extent consistent with federal requirements:
1-16                 (1)  on-site technical assistance;
1-17                 (2)  expedited permitting;
1-18                 (3)  reduced reporting and recordkeeping requirements;
1-19     and
1-20                 (4)  reduced inspections.
1-21           SECTION 2. This Act takes effect September 1, 2001.
