No. 1272 77R340 SMH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to exempting elderly license holders from certain 1-3 requirements for the renewal of a real estate broker license. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 7A, The Real Estate License Act (Article 1-6 6573a, Vernon's Texas Civil Statutes), is amended by adding 1-7 Subsection (h) to read as follows: 1-8 (h) Notwithstanding any other provision of this Act, a real 1-9 estate broker who is 70 years of age or older is not required to 1-10 comply with the mandatory continuing education requirements of this 1-11 section to renew the person's license. 1-12 SECTION 2. Section 11, The Real Estate License Act (Article 1-13 6573a, Vernon's Texas Civil Statutes), is amended to read as 1-14 follows: 1-15 Sec. 11. (a) The commission shall charge and collect the 1-16 following fees: 1-17 (1) a fee not to exceed $100 for the filing of an 1-18 original application for a real estate broker license; 1-19 (2) a fee not to exceed $100 for annual renewal of a 1-20 real estate broker license; 1-21 (3) a fee not to exceed $50 for the filing of an 1-22 original application for a real estate salesperson license; 1-23 (4) a fee not to exceed $50 for annual renewal of a 1-24 real estate salesperson license; 2-1 (5) a fee not to exceed $50 for an application for a 2-2 license examination; 2-3 (6) a fee not to exceed $20 for filing a request for a 2-4 license for each additional office or place of business; 2-5 (7) a fee not to exceed $20 for filing a request for a 2-6 license or certificate of registration for a change of place of 2-7 business, change of name, return to active status, or change of 2-8 sponsoring broker; 2-9 (8) a fee not to exceed $20 for filing a request to 2-10 replace a license or certificate of registration lost or destroyed; 2-11 (9) a fee not to exceed $400 for filing an application 2-12 for approval of an education program under Section 7(f) of this 2-13 Act; 2-14 (10) a fee not to exceed $200 a year for operation of 2-15 an education program under Section 7(f) of this Act; 2-16 (11) a fee of $15 for transcript evaluation; 2-17 (12) a fee not to exceed $10 for preparing a license 2-18 or registration history; 2-19 (13) a fee not to exceed $50 for the filing of an 2-20 application for a moral character determination; 2-21 (14) an annual fee of $20 from each real estate broker 2-22 and each registrant under Section 9A of this Act to be transmitted 2-23 to Texas A&M University for the Texas Real Estate Research Center 2-24 as provided by Section 5(m) of this Act; 2-25 (15) an annual fee of $17.50 from each real estate 2-26 salesperson to be transmitted to Texas A&M University for the Texas 2-27 Real Estate Research Center as provided by Section 5(m) of this 3-1 Act; 3-2 (16) an annual fee of $80 from each registrant under 3-3 Section 9A of this Act; and 3-4 (17) any fee authorized under Section 8 of this Act 3-5 for the real estate recovery fund. 3-6 (b) A fee imposed under Subsection (a)(2) of this section 3-7 does not apply to a person who is 70 years of age or older. 3-8 SECTION 3. (a) This Act takes effect September 1, 2001. 3-9 (b) The change in law made by this Act applies only to the 3-10 renewal of a real estate broker license that expires on or after 3-11 the effective date of this Act. The renewal of a real estate 3-12 broker license that expires before the effective date of this Act 3-13 is covered by the law in effect on the date the license expires, 3-14 and that law is continued in effect for that purpose.
