1-1                                   AN ACT
 1-2     relating to use of a student's legal surname in a public school.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter A, Chapter 25, Education Code, is
 1-5     amended by adding Section 25.0021 to read as follows:
 1-6           Sec. 25.0021.  USE OF LEGAL SURNAME.  In each public school a
 1-7     student must be identified by the student's legal surname as that
 1-8     name appears:
 1-9                 (1)  on the student's birth certificate or other
1-10     document suitable as proof of the student's identity; or
1-11                 (2)  in a court order changing the student's name.
1-12           SECTION 2.  This Act applies beginning with the 2001-2002
1-13     school year.
1-14           SECTION 3.  This Act takes effect immediately if it receives
1-15     a vote of two-thirds of all the members elected to each house, as
1-16     provided by Section 39, Article III, Texas Constitution.  If this
1-17     Act does not receive the vote necessary for immediate effect, this
1-18     Act takes effect September 1, 2001.
