No. 1276 1-2 (In the Senate - Received from the House May 11, 2001; 1-3 May 11, 2001, read first time and referred to Committee on 1-4 Education; May 11, 2001, reported favorably by the following vote: 1-5 Yeas 6, Nays 0; May 11, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to use of a student's legal surname in a public school. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Subchapter A, Chapter 25, Education Code, is 1-11 amended by adding Section 25.0021 to read as follows: 1-12 Sec. 25.0021. USE OF LEGAL SURNAME. In each public school a 1-13 student must be identified by the student's legal surname as that 1-14 name appears: 1-15 (1) on the student's birth certificate or other 1-16 document suitable as proof of the student's identity; or 1-17 (2) in a court order changing the student's name. 1-18 SECTION 2. This Act applies beginning with the 2001-2002 1-19 school year. 1-20 SECTION 3. This Act takes effect immediately if it receives 1-21 a vote of two-thirds of all the members elected to each house, as 1-22 provided by Section 39, Article III, Texas Constitution. If this 1-23 Act does not receive the vote necessary for immediate effect, this 1-24 Act takes effect September 1, 2001. 1-25 * * * * *
