                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to size limits for special education classes in public
 1-3     schools.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 25.112(a), Education Code, is amended to
 1-6     read as follows:
 1-7           (a)  Except as otherwise authorized by this section, a school
 1-8     district may not enroll more than 22 students in a kindergarten,
 1-9     first, second, third, or fourth grade class or more than 10
1-10     students in a special education class under Subchapter A, Chapter
1-11     29.  These limitations do [That limitation does] not apply during:
1-12                 (1)  any 12-week period of the school year selected by
1-13     the district, in the case of a district whose average daily
1-14     attendance is adjusted under Section 42.005(c); or
1-15                 (2)  the last 12 weeks of any school year in the case
1-16     of any other district.
1-17           SECTION 2.  This Act applies beginning with the 2001-2002
1-18     school year.
1-19           SECTION 3.  This Act takes effect immediately if it receives
1-20     a vote of two-thirds of all the members elected to each house, as
1-21     provided by Section 39, Article III, Texas Constitution.  If this
1-22     Act does not receive the vote necessary for immediate effect, this
1-23     Act takes effect September 1, 2001.
