 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to requirements applicable to child-care workers who
 1-9     receive scholarships funded by the federal Child Care Development
1-10     Fund.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Sections 302.006(c) and (e), Labor Code, as added
1-13     by Chapter 1433, Acts of the 76th Legislature, Regular Session,
1-14     1999, are amended to read as follows:
1-15           (c)  To be eligible to receive a scholarship awarded under
1-16     this section, a person must:
1-17                 (1)  be employed in a child-care facility, as defined
1-18     by  Section 42.002, Human Resources Code;
1-19                 (2)  intend to obtain a credential, certificate, or
1-20     degree specified in Subsection (b);
1-21                 (3)  agree to work for at least 18 additional months in
1-22     a child-care facility, as defined by  Section 42.002, Human
1-23     Resources Code, that accepts federal Child Care Development Fund
1-24     subsidies and that, at the time the person begins to fulfill the
1-25     work requirement imposed by this subdivision, is located:
1-26                       (A)  within the attendance zone of a public
1-27     school campus considered low-performing under Section 39.131(b),
1-28     Education Code; or
1-29                       (B)  in an economically disadvantaged community,
1-30     as determined by the commission [for at least 18 additional
1-31     months]; and
1-32                 (4)  satisfy any other requirements adopted by the
1-33     commission.
1-34           (e)  In addition, the commission may provide for payment of a
1-35     bonus or wage supplementation to a scholarship recipient who for 18
1-36     months after the date of receiving the scholarship provides care
1-37     for children younger than six years of age while remaining in the
1-38     employment of the child-care facility that employed the person when
1-39     the scholarship was awarded and that meets the requirements of
1-40     Subsection (c)(3).  Any bonus or wage supplementation provided
1-41     under this subsection shall be paid in equal shares by the
1-42     scholarship recipient's employer and the commission.  The
1-43     commission shall determine the amount of any bonus and the amount
1-44     and duration of any wage supplementation provided under this
1-45     subsection.
1-46           SECTION 2.  The change in law made by this Act applies only
1-47     to a recipient of a scholarship funded by the federal Child Care
1-48     Development Fund who accepts the scholarship on or after the
1-49     effective date of this Act.
1-50           SECTION 3.  This Act takes effect September 1, 2001.
