                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the regulation of signs and billboards located in
 1-3     residential areas, creating a penalty.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 216.901, Local Government Code, is
 1-6     amended by adding subsections (c) and (d):
 1-7           (c)  A municipality may regulate the size of a sign or
 1-8     billboard located in a residential area by charter or ordinance.
 1-9                 (1)  A sign, including a political sign, located in a
1-10     residential area may not be larger than 36 inches by 36 inches in
1-11     size.
1-12           (d)  A violation of a charter provision or ordinance adopted
1-13     under this section is punishable by a fine not to exceed $1,000.
1-14           SECTION 2.  Chapter 240, Local Government Code, is amended by
1-15     adding Section 240.908:
1-16           Section 240.908.  A commissioners court may regulate the size
1-17     of a sign or billboard located in a residential area by order.
1-18                 (1)  A sign, including a political sign, located in a
1-19     residential area may not be larger than 36 inches by 36 inches in
1-20     size.
1-21           (b)  A violation of an order adopted under this section is
1-22     punishable by a fine not to exceed $1,000.
 2-1           SECTION 3.  This Act takes effect September 1, 2001.
