No. 1330 77R14126 CAS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the provision of Internet service by regional education 1-3 service centers. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 8.053, Education Code, is amended to read 1-6 as follows: 1-7 Sec. 8.053. ADDITIONAL SERVICES. (a) In addition to the 1-8 services provided under Section 8.051 and the initiatives 1-9 implemented under Section 8.052, a regional education service 1-10 center may: 1-11 (1) offer any service requested and purchased by any 1-12 school district or campus in the state; and 1-13 (2) contract with a public or private entity for 1-14 services under this subchapter, including the provision of 1-15 continuing education courses and programs for educators. 1-16 (b) A regional education service center that provides home 1-17 Internet service to public school students, teachers, or other 1-18 school personnel shall adopt: 1-19 (1) appropriate methods to verify that each subscriber 1-20 to the Internet service is a public school student, a public school 1-21 teacher, or another public school employee; and 1-22 (2) rules to ensure that the Internet service provides 1-23 a mechanism to block or filter Internet access to websites 1-24 containing obscene materials. 2-1 SECTION 2. Section 8.053, Education Code, as amended by this 2-2 Act, applies only to a contract for the provision of Internet 2-3 service by a regional education service center that is entered into 2-4 or renewed on or after the effective date of this Act. A contract 2-5 for the provision of Internet service by a regional education 2-6 service center that is entered into or renewed before the effective 2-7 date of this Act is governed by the law in effect on the date the 2-8 contract was entered into or renewed, and the former law is 2-9 continued in effect for that purpose. 2-10 SECTION 3. This Act takes effect immediately if it receives a 2-11 vote of two-thirds of all the members elected to each house, as 2-12 provided by Section 39, Article III, Texas Constitution. If this 2-13 Act does not receive the vote necessary for immediate effect, this 2-14 Act takes effect September 1, 2001.
